1017-2(b):  DISMISSAL: Chapter 7 Trustee Files a Motion

LBR 1017-2(b) provides the procedure to follow when a chapter 7 trustee requests that the case be dismissed because the debtor failed to appear at the meeting of creditors required under Bankruptcy Code Section 341(a).

  • A request must be filed.  The court has a form request.  See link below.
  • A hearing is not required, under LBR 9013-1(q).
  • The trustee must file a Notice of Motion for Order Without Hearing under LBR 9013-1(q).  The court has a form notice.  See link below.
