5005-1: File Any Document: FEES and SIGNATURES required; Fee Schedule
** UPDATED 11-07-2024 **
LBR 5005-1 requires that proper signatures and fees be included with documents that are delivered to the court for filing. This includes bankruptcy petitions and schedules AND amended schedules.
LBR 9011-1 governs signature requirements. PLEASE SEE EDITS MADE TO THE TCG SECTION ON LBR 9011-1.
- The Board of Judges approved new procedures for what type of signatures are allowed. The new procedures became effective on 10-21-2024.
- The notation "/s/" is now authorized in four scenarios instead of just two scenarios.
- A software-generated signature is now authorized when a document will be filed via CM/ECF and the attorney who files the document obtains oral verification to file the software-generated signature.
- Holographic signatures are still required for all case commencement documents and amended case commencement documents.
- Under no circumstances may a reproduction of the same holographic signature or software generated signature be used on multiple pages or in multiple documents. This means a signature stamp does not qualify as a legitimate holographic signature.
LBR 1006-1 contains instructions about fees to file a bankruptcy petition and other documents that require a filing fee. See link below.
This Fee Schedule identifies documents that require fees and documents that do not require fees to file the document.
Instructions are also provided for the methods of making a payment, such as paying fees by a money order from the U.S. Postal Service, cashiers check from an approved financial institution, credit card of the attorney of record, or pay.gov for certain documents.
