7054-1(g):  Adversary Proceedings: ATTORNEYS FEES

LBR 7054-1(g) provides the procedure to follow when a prevailing party seeks payment of attorneys fees incurred during an adversary proceeding or contested matter. 

  • The prevailing party must file and serve a "Motion for Attorneys' Fees."  The court does not have a form motion. 
  • A hearing may or may not be required, depending on the judge's procedures.   Notice of the motion is governed by LBR 9013-1(c).  See links below.
