3020-1(a): Chapter 11: PLAN CONFIRMATION: Court Costs; 14-day stay; Modification
LBR 3020-1 provides that an order granting a motion to confirm a chapter 11 plan of reorganization must contain a provision that all court costs have been paid.
After a chapter 11 debtor or trustee files a motion to confirm a plan, the court will file a Notice to Pay Court Costs if costs remain unpaid.
FRBP 3020 contains numerous provisions about a hearing to confirm a plan, including who must be served with an objection to confirmation, contents to include in an order confirming a plan, and that an order confirming a chapter 9 or chapter 11 plan is stayed for 14 days unless the court orders otherwise.
FRBP 3019 contains provisions about modifying a chapter 11 plan before or after it is confirmed. FRBP 3019(b) provides that when a plan has been confirmed in an individual chapter 11 case, and a party files a request to modify the plan, other parties must be given at least 21-days of notice of the time to file an objection to the request for modification.
